Welcome to BettrUs! These Terms of Service ("Terms") govern your access to and use of the BettrUs platform, including our mobile applications, web services, APIs, and all related services (collectively, the "Services").

By creating an account, accessing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Account Registration

To access most features of BettrUs, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Be at least 16 years old (or the age of majority in your jurisdiction)
• Not create accounts for others without their permission

Account Security

You are responsible for all activities that occur under your account. You must:

• Use a strong, unique password for your BettrUs account
• Enable two-factor authentication when available
• Notify us immediately of any unauthorized access
• Not share your credentials with third parties

Business Accounts

If you create a business account, you represent that you have the authority to act on behalf of that business and bind it to these Terms. You may invite team members to your business account, and you are responsible for their compliance with these Terms.

Billing

• Paid plans are billed in advance on a monthly or annual basis
• All fees are exclusive of applicable taxes unless stated otherwise
• Prices may change with 30 days' notice to existing subscribers
• You authorize us to charge your payment method automatically

Free Trial

We offer a 14-day free trial for all plans. No credit card is required to start. At the end of your trial, you may choose to subscribe or your account will be limited to basic features.

Refunds

• Full refunds are available within 14 days of initial purchase
• Refunds for annual plans are prorated after 14 days
• Cancellations take effect at the end of the current billing period
• No refunds for partial months or unused features

Upgrades & Downgrades

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated charges. Downgrades take effect at the start of your next billing cycle.

You agree to use BettrUs only for lawful purposes and in accordance with these Terms. When using our Services, you must:

General Guidelines

• Comply with all applicable laws and regulations
• Respect the rights and privacy of others
• Use the Services only for their intended business purposes
• Maintain accurate and truthful information in your account
• Respond appropriately to customer feedback received

Feedback Collection

When collecting customer feedback through BettrUs, you agree to:

• Clearly identify the feedback as being collected for your business
• Not manipulate or artificially inflate feedback scores
• Not solicit fake or fraudulent reviews
• Respect customer privacy and anonymity preferences
• Not use collected feedback for purposes other than business improvement

QR Code Usage

QR codes generated by BettrUs must be used appropriately:

• Display codes only at your authorized business locations
• Do not modify or tamper with QR code links
• Remove codes promptly if you discontinue service

Our Intellectual Property

The BettrUs platform, including all content, features, functionality, software, designs, text, graphics, logos, and trademarks, is owned by Skyuva InfoTech Private Limited and protected by intellectual property laws. You may not:

• Copy, modify, or distribute our proprietary content
• Reverse engineer or decompile our software
• Use our trademarks without written permission
• Create derivative works based on our Services
• Remove any copyright or proprietary notices

License to Use

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Services for your internal business purposes. This license does not include any right to resell or commercially exploit the Services.

Feedback to BettrUs

If you provide suggestions, ideas, or feedback about our Services ("Suggestions"), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate such Suggestions into our Services without compensation or attribution.

Your Content

You retain ownership of all content you submit to BettrUs, including your business information, branding, and any responses you create. By using our Services, you grant us a license to host, display, and process your content as necessary to provide the Services.

Customer Feedback Data

Customer feedback collected through your QR codes is your business data. You are responsible for:

• How you use and respond to customer feedback
• Compliance with privacy laws regarding collected data
• Obtaining any necessary consents from your customers
• The accuracy of any representations about feedback collection

Data Processing

We process your data in accordance with our Privacy Policy. Our AI systems analyze feedback to provide insights, but we do not sell your data or use it to train models for third parties.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Implied warranties of merchantability and fitness for a particular purpose
• Warranties of non-infringement
• Warranties that the Services will be uninterrupted, error-free, or secure
• Warranties regarding the accuracy or reliability of AI-generated insights

AI Insights Disclaimer

Our AI-powered analysis provides insights based on submitted feedback. These insights are for informational purposes only and should not be the sole basis for business decisions. We do not guarantee the accuracy, completeness, or reliability of AI-generated recommendations.

Third-Party Services

Our Services may integrate with or link to third-party services. We are not responsible for the content, privacy practices, or availability of these third-party services.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BETTRUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Cost of substitute products or services
• Any damages arising from unauthorized access to your account
• Any damages exceeding the fees paid by you in the 12 months preceding the claim

Essential Purpose

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such cases, our liability will be limited to the maximum extent permitted by applicable law.

Indemnification

You agree to indemnify and hold BettrUs harmless from any claims, damages, losses, or expenses arising from your use of the Services, violation of these Terms, or infringement of any third-party rights.

Termination by You

You may terminate your account at any time through your account settings or by contacting support. Upon termination:

• Your right to access the Services will cease immediately
• Any outstanding fees will become due
• Your data will be retained for 30 days before deletion
• You may request a data export before deletion

Termination by BettrUs

We may suspend or terminate your account at any time if:

• You violate these Terms or our policies
• Your use poses a security risk to us or others
• Required by law or regulatory authority
• Your account has been inactive for 12 months or more

Effect of Termination

Upon termination, sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law will survive.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Dispute Resolution

Any disputes arising from these Terms or your use of the Services will be resolved as follows:

• Informal Resolution: We encourage you to contact us first to resolve any disputes informally.
• Arbitration: If informal resolution fails, disputes will be resolved by binding arbitration under the rules of the American Arbitration Association.
• Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits.

Exceptions

Either party may seek injunctive relief in court for intellectual property infringement or unauthorized access to the Services.

We may modify these Terms at any time. When we make changes:

• We will update the "Last updated" date at the top
• For material changes, we will notify you via email or in-app notification at least 30 days in advance
• Your continued use of the Services after changes take effect constitutes acceptance
• If you disagree with changes, you may terminate your account before they take effect
